Sicherheit im Vorfeld des Rechts

Abstract

Der Autor stellt anhand der Aussagen führender Kriminalisten Struktur und Zielsetzung vorbeugender Verbrechensbekämpfung dar. Er zeigt, daß die präventionistischen Vorstellungen über vorbeugende Verbrechensbekämpfung sich nicht an einem formellen Verbrechensbegriff orientieren, sondern am Begriff sozialschädlichen Verhaltens. Solch, vorbeugende Verbrechensbekämpfung gerät in Widerspruch zu rechtsstaatlichen Beschränkungen des staatlichen Gewaltmonopols und führt zur Institutionalisierung eines Sicherheitsstaates im Vorfeld des Rechts.

The author discusses the main characteristics of the debate about the necessity of the prevention of crime. He shows that security tends to be developed from a problem of prevention and repression of illegal hehaviour to a problem of reproducing and guaranteeing the social order. This new function of prevention of crime can not be realized in the boundaries of the rule of law, and is therefore institutionalizing a security state as the basis of the legal state.
